IMPORTANT: THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING.

This agreement is entered into by the undersigned parent(s), legal guardian(s), or caregiver(s) (hereinafter referred to as “I”, “me”, or “Participant”) and Wildlings Play Café (hereinafter referred to as the “Business”), including its owners, operators, employees, agents, contractors, volunteers, landlords, and affiliates.

1. Acknowledgement of Risk

I understand that participation in activities at Wildlings Play Café, including but not limited to indoor play structures, climbing, sliding, imaginative play, soft play, running, and interaction with other children and adults, involves inherent risks. I acknowledge that public spaces can expose participants to common illnesses (e.g., colds, flu, RSV, COVID-19) and allergens. Risks include, but are not limited to:

• Minor injuries (e.g., bruises, scrapes, sprains)

• Serious injuries (e.g., fractures, concussions)

• Illness (e.g., communicable diseases including COVID-19)

• Emotional distress or behavioral incidents

• Damage or loss of personal property

I voluntarily assume all risks associated with participation for myself and the minor child(ren) identified in this agreement.

2. Release and Waiver of Liability

In consideration of being permitted to enter and participate in activities at Wildlings Play Café, I, on behalf of myself, my spouse, my heirs, and on behalf of the minor child(ren) identified in this agreement, hereby release, waive, and discharge the Business and its affiliates from any and all claims, demands, or causes of action for injury, illness, loss, or damage, whether caused by the negligence of the Business or otherwise.

3. Supervision and Responsibility

I agree that:

​

• I am responsible for supervising my child(ren) at all times.

• I will not leave my child(ren) unattended (including visiting the washroom).

• I will ensure my child(ren) follow posted rules and staff instructions.

• I accept liability for any injury or damage caused by my child(ren)’s actions.

4. Safety Rules and Conduct

​

I agree to abide by the following rules:

​

• Socks must be worn in play areas; no shoes allowed.

• No outside food or drink (except for medical or infant needs).

• No roughhousing, pushing, or bullying.

• Age-appropriate play areas must be respected.

• Food and drinks must remain in designated café areas.

• Sick individuals will be asked to leave.

• No climbing on the exterior of play structures including slides.

• Staff may remove individuals who pose safety risks or violate rules.

 

5. Medical Emergencies

I authorize Wildlings Play Café staff to administer basic first aid and/or contact emergency services if needed. I accept responsibility for all related medical costs.

6. COVID-19 and Communicable Diseases

I acknowledge the risks of exposure to COVID-19 and other illnesses. I voluntarily assume these risks and agree that Wildlings Play Café is not liable for any resulting illness or consequences.

7. Personal Property

I understand that Wildlings Play Café is not responsible for lost, stolen, or damaged personal items.

8. Photo and Video Release

I grant permission for Wildlings Play Café to use security footage for safety and legal purposes. Promotional use of images will require separate explicit consent.

 

9. Indemnification

I agree to indemnify, defend, and hold harmless Wildlings Play Café and its affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising from: (a) my or my child(ren)'s participation in activities; (b) my or my child(ren)'s presence on the premises; or (c) any claim made by or on behalf of the minor child(ren) against the Business, regardless of whether the claim arises from the negligence of the Business.

10. Severability

If any part of this agreement is found invalid, the remainder shall remain in full force and effect.

11. Governing Law

​

This agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

​

This Agreement constitutes the entire agreement of the Business and me with respect to the
subject matter contained herein and supersedes all prior and contemporaneous understandings,
agreements, representations, and warranties, both written and oral, with respect to such subject
matter.

If any term or provision of this Agreement is held to be invalid, illegal, or unenforceable in any
jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or
provision of this Agreement.

This Agreement is binding on and shall endure to the benefit of me and my heirs and next-of-kin,
and the Business and its successors and assigns.

This Agreement, including all matters arising out of or relating to this Agreement, shall be
governed by and construed in accordance with the laws of the Province of Ontario and the
federal laws of Canada applicable therein.
